Memos Terms of Use

Version 1.0 · Last updated: November 7, 2026 · Effective: from [DATA DE PUBLICAÇÃO NA GOOGLE PLAY]

1. Who offers Memos and how these Terms work

1.1. Who we are. Memos is offered by [NOME COMPLETO], an individual (independent developer), published on Google Play under the developer name [NOME EXIBIDO NA GOOGLE PLAY] (the "Developer", "we", "us"). Contact details are in section 17. Where the law of a country requires other identifying information (such as an address and telephone number), it is shown on the Memos page on Google Play.

1.2. Acceptance. By installing, opening or using Memos, you declare that you have read and agree to these Terms. If you do not agree, do not use the app and uninstall it.

1.3. Who is a party. These Terms apply between you and the Developer. Google (Google Play) distributes the app and processes the payment, but is not a party to these Terms and is not responsible for Memos. Google Play's terms continue to apply to your Google account and your payments.

1.4. Who may use it. Memos is not directed at children under 13 (or the higher age required by the law of your country). Minors must use the app with the knowledge and supervision of a legal guardian. The Lifetime plan may only be purchased by someone who is of legal age in their country, or by minors duly represented or assisted by a legal guardian.

1.5. Related documents. Memos' Privacy Policy, available at [URL DA POLÍTICA DE PRIVACIDADE], is part of these Terms as far as personal data is concerned.

2. What Memos is

2.1. Memos is an Android application that lets you:

2.2. Memos works without an account and without internet. The internet is used only to check your plan and show the Lifetime price when you open the app, and to buy or restore the Lifetime plan (section 9.3).

2.3. This version has no login, sign-up, syncing between devices or cloud storage. If that changes, we will update these Terms and the Privacy Policy beforehand (section 14).

3. License to use and what is not allowed

3.1. License. We grant you a personal, non-exclusive, non-transferable and non-sublicensable license to install and use Memos on your Android devices, under the terms of the plan you have. The license is free on the Free plan and is paid, once only, on the Lifetime plan. You may use the app for your own personal or professional purposes, but not to resell it or to provide a service to third parties with it.

3.2. You agree not to:

4. Your content and your responsibility for it

4.1. The content is yours. The texts, photos, audio, documents, categories and reminders you create in Memos remain yours. We do not ask for any license over them.

4.2. We have no access to it. The content stays in the app's private storage on your device. It is not sent to the Developer, who therefore cannot see, recover, restore or moderate it.

4.3. Your responsibility. You are responsible for what you record and attach. In particular:

4.4. What leaves the app leaves our control. When you open a document in another app, use the "Share" menu, save a backup to a folder or send it by email, message or a third-party cloud, that content becomes subject to the rules and risks of the destination app or service.

5. Device permissions

5.1. Memos asks only for the permissions it needs and asks at the moment you use the feature:

PermissionWhat it is for
MicrophoneRecording the event's audio
CameraTaking photos for the event
Photos and filesChoosing images, documents and backup files that you select
NotificationsShowing reminder alerts
Exact alarms and remindersTriggering the reminder at the set time
Internet and Google Play BillingChecking the plan and price, and buying and restoring the Lifetime plan

5.2. You may deny or withdraw a permission at any time in Android's settings. Without it, only the related feature stops working; the rest of the app remains available.

5.3. We use each permission only for the purpose in the table above.

5.4. Android may also list routine technical permissions that do not involve your personal data, such as vibrating, keeping the device awake during the alert, rescheduling reminders after a restart, checking the network state, showing the number of alerts on the app icon (on some manufacturers' devices) and, on devices running Android 12 or earlier, accessing storage to choose and save photos and files. Memos uses only what you choose. Some libraries used by the app also declare permissions that Memos does not use, such as receiving Google push messages and reading the Google Play install referrer; Memos does not activate those features. This version does not ask for location, contacts, SMS or the advertising identifier.

6. Plans, purchase and refunds

6.1. Free plan. It is free of charge and has the limits in Annex A. Memos will remain available to download and use free of charge on the Free plan.

6.2. Lifetime plan. It is a one-time purchase, made through Google Play's payment system, with no monthly fee and no renewal. It removes the Free limits and unlocks the full backup, as set out in Annex A.

6.3. What "lifetime" means. It means you do not pay again to keep the Lifetime plan. It does not mean the lifetime of any person, nor an obligation to maintain Memos forever. The Lifetime plan is valid for as long as Memos is offered and maintained by the Developer. If we intend to discontinue the app, we will notify you through the app itself and the store listing with reasonable advance notice (the goal is at least 90 days) and, whenever technically possible, we will keep the ability to export your data.

6.4. Price. The price appears on Google Play's purchase screen, in your country's currency and with applicable taxes, before you confirm. It may vary by country and change over time, including through promotions. A price change does not affect those who have already purchased.

6.5. Cloud and future plans. The Lifetime plan does not include cloud storage or syncing between devices. We may offer those features in the future in separate plans (for example, monthly or annual), with no obligation to include them in the Lifetime plan. We may, at our discretion, offer special conditions to those who have already purchased the Lifetime plan.

6.6. Payment. Payment is processed by Google Play. The Developer does not receive or store your card or other payment method details. The purchase is tied to the Google account used for it. To recover the Lifetime plan on another device, or after reinstalling the app, sign in with the same Google account and use "Restore purchase" (internet is required). The purchase cannot be transferred to another Google account. If the payment is pending, the Lifetime plan is unlocked when it is confirmed.

6.7. Purchase verification service. We use RevenueCat, a third-party service, to confirm and manage the Lifetime purchase (section 9).

6.8. Withdrawal and refund. Your rights depend on the country where you live:

The Developer authorizes Google to grant refunds in accordance with Google Play's policies. Request one through Google Play's orders page; if you cannot do so there, write to the contact in section 17 within the period, with the order number, and we will arrange the refund to the extent Google Play allows.

6.9. Effect of a refund or chargeback. If the purchase is refunded or charged back, the app returns to the Free plan. Your data remains on the device and nothing is deleted. The Free limits then apply only to adding new items, and backup (export) is no longer available.

7. Backup and data loss

7.1. Data stays only on your device. Because there is no cloud, reinstalling the app, clearing the app's data, uninstalling, replacing, losing, breaking or factory-resetting the device permanently erases the data, unless you have a Memos backup. The Developer has no copy and cannot recover it.

7.2. Android automatic backup turned off. Memos deliberately turns off Android's (Google's) automatic backup. Protection against data loss is Memos' own backup, a feature of the Lifetime plan.

7.3. Memos backup (Lifetime). It generates a .zip file with your events, categories, reminders (with their alarms) and the attached media (photos, audio and documents). You choose where to store it. Note: the file is not encrypted. Anyone with access to it can open it and see your texts, photos, audio and documents. Keep it in a safe place. If you send it to another app or service (email, message, cloud), it will exist there, outside our control.

7.4. Import. Importing a backup adds the data in the file to the data already in the app and does not delete anything. Import only files that you generated yourself or that come from a trusted source. The app checks the format and content of the file before saving, but cannot guarantee that a file altered by third parties is harmless. On the Free plan, the import respects the Free limits: the most recent events that fit are imported, and the excess is not imported.

7.5. Your responsibility. Make backups as often as your content deserves. Also check that there is free space on the device: backup and import need it.

8. Reminders and notifications

8.1. Reminders are scheduled and alerted on the device itself, without internet.

8.2. They depend on your device's permissions and settings, such as notifications, exact alarms, "Do not disturb" mode, battery saving, manufacturer settings (for example, background app restrictions on some brands) and the time zone. System updates, restarts or time changes may also affect the alert.

8.3. For this reason, we do not guarantee that the notification will arrive on time and we do not recommend Memos as the only way to remember something critical, such as medication, legal deadlines or safety commitments.

9. Privacy and personal data protection

This section summarizes how we process personal data, in line with Brazil's Lei Geral de Proteção de Dados (LGPD, Law No. 13,709/2018) and, for those who live in other countries, with applicable data protection laws, such as the European GDPR. The details, including rights by country, are in the Privacy Policy.

9.1. Memos' principle. The app was designed to keep everything on the device. This version has no account, shows no ads, includes no usage analytics or tracking tools and does not sell data.

9.2. The content of your records does not reach us. Texts, photos, audio, documents, categories and reminders stay on the device. You decide about, and control, that content: you can view, edit, delete and export it whenever you wish.

9.3. Data processed to verify, buy and restore the Lifetime plan. Whenever you open the app with internet (to find out whether you have the Lifetime plan and to show the price in your country), and when you buy or restore the plan, Google Play and RevenueCat process:

We also process the email and message you send us when requesting support or exercising your rights, and we see in the Play Console the sales and crash statistics that Google Play provides to the developer and, in the RevenueCat dashboard, the purchase reports.

9.4. What we use this data for and the legal basis.

PurposeLegal basis (LGPD, art. 7)
Unlocking, maintaining and restoring the Lifetime plan you purchasedV, performance of a contract to which you are a party
Complying with tax, accounting and legal obligations related to the saleII, compliance with a legal or regulatory obligation
Preventing fraud and improper refundsIX, legitimate interest, respecting your rights and freedoms
Analyzing the app's sales, such as number of purchases, revenue and refundsIX, legitimate interest, respecting your rights and freedoms
Responding to support and data subject rights requests, and keeping the record for defense in any disputeV, performance of a contract; II, compliance with a legal obligation; VI, regular exercise of rights in proceedings

9.5. Who we share it with. Only with the providers necessary for the purchase and for contacting you, who act under their own policies:

ProviderFunctionPrivacy policy
Google (Google Play)App distribution, payment processing and store sales and crash statisticshttps://policies.google.com/privacy
RevenueCat, Inc. (United States)Acts on our behalf (as processor) in verifying and managing the Lifetime purchase and provides sales reportshttps://www.revenuecat.com/privacy
Provider of the email service we useStores the messages you send us and our repliesThe provider's policy

We do not sell or rent personal data and do not use it for advertising.

9.6. International transfer. These providers may process data outside Brazil, including in the United States, where RevenueCat's servers are located. This happens only to the extent necessary for the purchase and with the safeguards the LGPD requires (art. 33), in accordance with these providers' policies and contracts. For data of people in the European Economic Area, the United Kingdom and Switzerland, the contract with RevenueCat uses the European Commission's Standard Contractual Clauses (Privacy Policy, section 6).

9.7. How long we keep it. The app's content stays on the device until you delete it, clear the app's data or uninstall it. Purchase data stays with Google and RevenueCat for as long as necessary to maintain the Lifetime plan, meet legal and tax obligations and prevent fraud. Messages you send us are kept for as long as necessary to handle the request and, afterwards, for the legal period for any defense.

9.8. Your rights. Under the LGPD (art. 18), you may request, at any time and free of charge:

To exercise these rights, write to the contact in section 17. We will respond in a simple and immediate manner where possible or, at most, within 15 days with a complete declaration (LGPD, art. 19). You may also complain to the Autoridade Nacional de Proteção de Dados (ANPD, Brazil's National Data Protection Authority). If you live outside Brazil, you also have the rights under the law of your country (for example, under the GDPR, a response within 1 month and a complaint to the local data protection authority); see section 13 of the Privacy Policy. Remember that the content of your records is not with us: to delete or export it, use the app itself.

9.9. Security. The content stays in the app's private storage on Android; Google's automatic backup is turned off; the import validates the file before saving; and communication with Google Play and RevenueCat is protected by their mechanisms. This version of Memos has no password or biometrics of its own and does not encrypt the backup file. Protect your device with a screen lock and keep backups in a safe place. If there is a security incident involving data we process that may cause you relevant risk or harm, we will notify you and the ANPD in accordance with the LGPD (art. 48) and, where the law of another country requires, the other competent authorities, within the legal deadlines.

9.10. Children and adolescents. Memos is not directed at children under 13 (section 1.4) and does not knowingly collect their data. The processing of data of children and adolescents must serve their best interests (LGPD, art. 14). If you are responsible for a minor and believe their data has been processed improperly, contact us.

9.11. Data subject channel and data protection officer. The channel for privacy matters and for exercising your rights is the email in section 17, handled by the Developer personally. As a small-scale processing agent, the Developer is exempt from appointing a data protection officer (Resolução CD/ANPD No. 2/2022, art. 11); that email is the channel of communication with data subjects and with the ANPD.

10. Intellectual property

10.1. Memos, including the code, name, logo, icon, screen design, texts and translations, belongs to the Developer or is used under license and is protected by copyright and intellectual property legislation (including Law No. 9,609/1998). The license in section 3 does not transfer any of those rights to you.

10.2. Memos uses third-party open-source components, governed by their respective licenses. Third-party names and trademarks (such as Google, Android and RevenueCat) belong to their owners.

10.3. If you send suggestions or comments about the app, we may use them to improve it, with no obligation of payment or credit.

11. Updates, availability and support

11.1. Memos is updated through Google Play. We may fix errors, improve, change or remove features for technical, security or legal reasons or because of store rules. We will not remove from the Lifetime plan, without justification, essential features that existed when you purchased. Changes to the Free limits do not delete what you have already created. Keep the app up to date.

11.2. The app is offered "as is": we do not promise uninterrupted operation or the absence of errors, without prejudice to the statutory warranty of the Código de Defesa do Consumidor and the mandatory warranties of the law of your country.

11.3. Support is by email (section 17). We respond within 3 business days.

12. Limitation of liability

12.1. To the maximum extent permitted by law, the Developer is not liable for damages arising from:

12.2. Nothing in these Terms excludes or limits rights that the law guarantees you as a consumer, nor the Developer's liability for willful misconduct or for damages that the law does not allow to be limited.

13. Suspension and termination

13.1. You may stop using Memos whenever you wish by uninstalling the app. Uninstalling erases the app's data on the device: export a backup first if you want to keep it.

13.2. We may suspend or restrict use of the Lifetime plan in case of fraud, refund or chargeback of the purchase, or serious breach of these Terms.

13.3. If Google Play stops distributing Memos, those who have already installed it may continue to use it to the extent Google Play and Android allow.

13.4. The sections on intellectual property, limitation of liability and governing law and venue remain in force after termination.

14. Changes to these Terms

14.1. We may update these Terms, for example to reflect new features or changes in the law or in Google Play's rules. The version in force and its date are always at the beginning of this document, at [URL DOS TERMOS] and, when available, inside the app.

14.2. For relevant changes, we will give notice through the app or the store listing with reasonable advance notice (the goal is at least 15 days), unless an immediate change is required by law or by the store. If you continue to use Memos after the new version takes effect, it applies to you.

14.3. If you do not agree with the new version, stop using the app. If the change significantly reduces what you purchased, contact us so we can discuss a solution, including a refund where the law requires it.

14.4. If Memos begins to have login, syncing, cloud or new services that process personal data, the Privacy Policy will be updated beforehand and the notice will be clear.

15. Governing law and venue

15.1. These Terms are governed by the laws of Brazil, in particular the Código de Defesa do Consumidor (Law No. 8,078/1990), the Marco Civil da Internet (Brazilian Internet Civil Framework, Law No. 12,965/2014), the LGPD (Law No. 13,709/2018) and the Código Civil (Brazilian Civil Code).

15.2. If you are a consumer in Brazil, the competent venue is that of your domicile.

15.3. If you are a consumer and live outside Brazil, the choice of Brazilian law does not remove the protection that the mandatory rules of your country of residence give you, and you may bring a dispute before the courts of your country where its law permits.

15.4. Before any formal measure, use the contact in section 17. In Brazil, you may also turn to Procon, consumidor.gov.br and, in matters of personal data, the ANPD. In other countries, you may contact your country's consumer protection body and data protection authority.

16. General provisions

16.1. Language. These Terms and the Privacy Policy are offered in several languages. In case of discrepancy between versions, the Brazilian Portuguese version prevails, except where the law of your country requires the version in your language to prevail.

16.2. Invalid parts. If any clause is held invalid, the others remain in force. Failing to exercise a right does not mean waiving it.

16.3. Transfer of the app. We may transfer Memos and these Terms to whoever starts operating it (for example, a company the Developer may form), maintaining your rights and notifying you through the app or the store listing.

16.4. Entire agreement. These Terms and the Privacy Policy form the agreement between you and the Developer regarding Memos. Google Play's terms, which govern your account and your payments, continue to apply alongside them.
